The Brief Doctor
The movie industry uses “script doctors” to improve screenplays written by others. The “doctor” reads the script and suggests improvements. “Dr.” Robert Towne doctored the script for The Godfather, which won an Academy Award for screenwriter Mario Puzo. And “Dr.” Tom Stoppard doctored the script for Shakespeare in Love, which won an Academy Award for screenwriter Marc Norman. The original scripts were good, but an extra pair of experienced eyes took them over the top.
Myron Moskovitz is a “Brief Doctor.” He has a pretty good idea of what wins cases. (His own appellate win record is more than triple the statewide average.) For years, Myron has been reviewing lawyers’ draft briefs and suggesting improvements—helping brief-writers win their cases.
Myron doctors briefs for cases pending in both state and federal courts—not just in appellate courts, but also in trial courts, helping win important motions for summary judgment and post-trial motions. He works quickly, getting his suggestions back to attorneys timely and at a reasonable cost.
The ultimate beneficiary is the client, but this process can help the lawyer too. While Myron teaches the general principles of strategic brief-writing to bar associations, his work as a Brief Doctor ends up mentoring attorneys one-on-one—using actual cases the lawyers know well. He shows them how to write a more powerful Introduction, a more persuasive Statement of Facts, and a well-structured Argument that integrates the facts with case-supported policy. He helps brief-writers view every section of the brief strategically, with each part supporting the whole, creating a final product that is more likely to win the motion or appeal.
